Our story
We are regular Canadians. We wanted a simple backyard pool for our family. We met Micah Munro when he ran Munro Luxury Pools and Spas in the Collingwood area. He was charming and kind at the start and he worked with his wife, Lindsay Munro, on design. In 2022 he helped us install a hot tub. We were happy with that job.
Then we asked Micah Munro to install a pool. He told us we needed to put down deposits greater than $100,000 so Leisure Pools could manufacture it and hold it in the Kingston yard. Based on what we were told we understood our order was secured and that a pool shell was sitting in Kingston.
In mid July 2024 after hearing about the bankruptcy we contacted Leisure Pools Canada and Leisure Pools USA. We were told there was no order and no deposit in our name and that Micah Munro had not put the order through. These conversations were with Paul Kennedy in Canada and Michael Kennedy in the United States.
After the bankruptcy
After the bankruptcy Micah Munro contacted us offering to sell equipment he said was held under other numbered companies that were separate from the pool company. He offered to sell it to us at market value around $50,000 so we could recover some of our loss. We declined because we did not have the funds and we did not want to risk being left at an even greater loss if things went wrong again. We were also disappointed. In our opinion an ethical person who contributed to a customer’s significant financial loss would have offered such equipment to make things right, especially given those assets were outside the pool company and not reachable by its creditors.
What we were told and what we later learned
What we were told
- The pool was ordered and being held in the Kingston yard.
- Our deposits were used to secure our specific pool.
- The project was ready to start after the second payment.
What we later learned
- Leisure Pools Canada and USA told us there was no order and no deposit in our name.
- We were told that Micah Munro had not put the order through.
- Soon after our second payment the business went into bankruptcy.
Key actions that concern us
- Took large deposits while the business was, in our understanding, in serious trouble.
- Told us the pool was already in Kingston although the manufacturer later told us there was no order and no deposit in our name.
- Offered to sell equipment after bankruptcy from other companies at market value to help us recover. We declined for the reasons above.
- Relocated from Collingwood to Peterborough and began a new career while many customers were, in our view, left with losses or unfinished projects.
Why we are sharing this
We understand that companies can fail. We took our time to document this so others can learn from our experience with Micah Munro. People often say that people never change. In our opinion we would not trust Micah Munro with large transactions for major life projects like we did.
Legal context in plain language
Some people think that if someone acts through a company they personally cannot be held responsible. In Canada that is not true. Individuals can still be personally accountable if they knowingly make false statements take money and fail to deliver. The fact that something was done as the company does not automatically protect the person behind it. Those making key decisions sometimes called directing minds can be personally pursued if their actions are dishonest or misleading.
